At about 3:21pm, on Friday, October 1, 2010, officers from Area A-7 (East Boston) responded to a radio call for an unconscious male slumped over the steering wheel of his vehicle, with the engine still running, in the area of 231 Brooks Road. On arrival, officers spoke to members of the Boston Fire Department who stated that, when they showed up on the scene, they observed an individual slumped over the wheel of a car that was still running. Seeing this, members of the Boston Fire Department approached the individual to check on his well being. Fire Department personnel state, at this point, they woke the suspect up. Members of the Boston Fire Department further state that the individual, who had red bloodshot eyes, appeared to be dazed and confused.  

Officers observed the individual standing next to his motor vehicle. While speaking to the suspect, officer also noted and observed that the suspect had bloodshot eyes, slurred speech and an inability to maintain his balance. When asked if he had been drinking or done any drugs, the suspect replied, “No.”  However, when officers leaned into the suspect’s car to take the keys out of the ignition, officers were able to detect a strong odor of what smelled like burnt and not burnt marijuana. Additionally, officers observed ice cream popsicles which were melted on the front passenger seat. When asked if there was any marijuana inside the car, the suspect stated, “No.” However, a search of the car enabled officers to locate and take possession of an undisclosed amount of marijuana, various drug paraphernalia and $48,000 in US currency.

Officers arrested Andrew Walsh, 24, of Walpole and charged him with Possession with Intent to Distribute a Class D Drug (marijuana).

The suspect later told officers that he was a college student majoring in Plant Management.
