Loud Party Call Leads to Call for Shots Fired

About 7:17AM on Saturday, January 1, 2011, officers from District E-5 (West Roxbury) arrested suspects, Rudolfo Pena, 30 of Roslindale and charged him with Unlawful Possession of a Firearm and Harvey Acosta, 32 of Quincy and charged him with Malicious Destruction of Property.

Officers had initially responded to 148 Fawndale St. #1 for a call for a loud party earlier in the night and spoke with the apartment owner who assured officers that she would address the issue.  Despite this promise, officers were once again called to the same apartment an hour later for a call for shots fired.

On arrival, officers spoke to the owner of the apartment who stated that there had been an altercation in her apartment between a group of partygoers when officers first responded to the apartment. The owner of the apartment then reported to officers that one of the initial parties to the fight, Acosta was kicked out of the party and came back with suspect Pena. Once the parties came back, another fight started which spilled out into the hallway and outside which resulted in the owner of the party’s front window being smashed.  While officer were processing the scene, they recovered ballistic evidence. A short time later, officers observed the two suspects who were involved in the fight a short distance from the party.  As officers approached the suspects to further investigate the two suspects, suspect Pena was observed tossing something to the side. Officers then went to the nearby snow bank and there observed a .25 caliber semi-automatic handgun which didn’t match the caliber of the bullets found at the scene.
