One Less Gun: Trespassing and Public Drinking Lands One in Custody and Allows Officers to Recover One Illegal Firearm

At about 11:47 PM on Sunday, June 15, 2014, members of the Boston Police Youth Violence Strike Force made an onsite arrest of an individual carrying an illegal firearm in the area of 1 Parkview Street in District C-11 (Dorchester).

While on patrol, officers observed a group congregated on American Legion Highway in the area of Franklin Park, where posted signs stating "No Alcoholics Beverages" and "Park Closes at 11:30 PM" were clearly visible. As the officers approached the group, officers immediately observed open containers of alcohol, as well as numerous individuals drinking alcohol from clear plastic cups. When officers began to speak to the group, two individuals abruptly walked away from the area. At that time, officers made their way towards the two individuals. Officers instructed the two males to stop, but the males ignored the officers. Officers observed that one of the individuals was holding a white bag with both hands in front of him.  As officer came closer to the males, the suspect began to sprint while still holding the bag in front of him.  Officers pursued the suspect on foot as he jumped over a wall and ran through a parking lot and toward a fence. Officers observed the suspect throw the bag over the fence and into the rear yard of 1 Parkway Street. Officers apprehended the suspect as he attempted to climb the fence.

Further investigation revealed a loaded Ruger P85 9mm inside the suspect’s bag. When the suspect could not produce a license to carry, officers arrested the 19-year-old male of Boston and charged him with Trespassing, Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, Carrying a Loaded Firearm on a Public Way, Possession of a Large Capacity Feeding Device, and Resisting Arrest.
