At about 11:27 PM on Thursday, February 1, 2018, officers from District B-3 (Mattapan) were on patrol in the area of Blue Hill Avenue and Harvard Street, Dorchester and observed a gray Infiniti operating on the public roadway. Officers conducted a random query of the vehicle and observed that the vehicle had been reported stolen from a rental company and had been rented with fraudulent credit cards. Officers conducted a stop of the vehicle and made contact with the operator and his front seat passenger. The operator, identified as 21-year-old Kevin Achille of Dorchester, was initially uncooperative with officers and was ultimately removed from the vehicle and placed under arrest for Receiving Stolen Property (Motor Vehicle). The passenger, identified as 21-year-old Austin Waite of Dorchester, was ordered to exit the vehicle, and as he did so, officers observed a firearm holstered at his waistline. Officers secured the firearm and demanded Waite’s License to Carry. When he told officers that he did not have one, and officers confirmed this information on their mobile data terminal, officers placed Waite under arrest. Officers seized the loaded black SAR Arms 9mm firearm, and further investigation revealed it had been reported stolen in 2016 out of Albuquerque, NM. Officers charged Waite with Unlawful Possession of a Firearm, Unlawful Possession of Ammunition, Unlawfully Carrying a Loaded Firearm, Unlawful Possession of a High Capacity Feeding Device, and Receiving Stolen Property (Firearm).
